Easement / Statutory Right of Way (R.O.W.) - Although the two terms are commonly used interchangeably, an easement is more specifically a defined area of a private property over which certain legal rights are given to another, usually adjacent, property (commonly for access, utility or encroachment purposes). A Statutory Right of Way is a similar legal arrangement, but where the legal rights over a property are given to a governmental or quasi-governmental body.
