Submission Requirements for Applications to Subdivide a Strata Lot

Legislation pertaining to Strata Plan Amendments is contained in Part 15 of the British Columbia Strata Property Act. Prior to filing a strata plan amendment, the applicant should contact the Enquiry Centre (604.873.7613) on the Second Floor, East Wing of City Hall, to discuss whether development and building permit applications are first required to increase the number of units or to change the approved use. An applicant must secure any required permits in this regard before submitting a strata plan amendment.

An application to amend a strata plan must include the following:

1. A letter of application, which clearly states:

• the property address and legal description;
• the intended use of each proposed strata lot;
• relevant Development and/or Building Permit numbers; and
• the name, address, telephone and fax numbers of the person making the application.

2. A letter of authorization from the property owner, if you are making the application on their behalf.

3. A special resolution of the strata corporation supporting the application to subdivide, unless exempted pursuant to Section 260 of the Strata Property Act.

4. A current title search of the strata lot(s) involved in the proposal, from the Land Title Office in New Westminster. You may be asked to provide copies of any charges on title, or submit a charge summary prepared by a lawyer, if they are extensive.

5. A copy of the current strata plan.

6. Either a sketch plan or a survey plan which clearly shows how you intend to subdivide the strata lot.

7. A non-refundable fee as shown below, which includes HST on the Special Inspection. Cheques should be made out to the “City of Vancouver”.
