  <P><B><I><FONT face=3D"Times New Roman" size=3D3>GENERAL MANAGER=92S=20
  COMMENTS</FONT></I></B></P>
  <UL>
    <UL>
      <P><B><I><FONT face=3D"Times New Roman" size=3D3>The General =
Manager of=20
      Community Services RECOMMENDS approval of A, C and D. Noting that =
1999 is=20
      expected to be another difficult budget year, that Council has =
already=20
      directed a $130,000 reduction in the overall policy planning =
budget=20
      available for this kind of work, and that the blueways work is =
less urgent=20
      than other policy priorities, the General Manager of Community =
Services,=20
      submits B for CONSIDERATION.</FONT></I></B></P></UL></UL>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>COUNCIL =
POLICY</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>A number of policies =
for specific=20
  water bodies have been adopted including:</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>=B7 encourage the =
diversity of=20
  marine uses; remove boat sheds; and provide for floating homes, =
seaplanes and=20
  charter boats (Coal Harbour ODP, 1990);</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>=B7 limit marina size =
and location=20
  to maintain a substantial water basin (FCCDD, 1974, False Creek North =
ODP,=20
  1990);</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>=B7 design shoreline =
treatments to=20
  enhance fish habitat and improve water quality (Shoreline Treatment =
Concepts,=20
  1991); and</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>=B7 reclaim an =
estuary habitat in=20
  the Fraser Lands (Fraser Lands Rezoning, 1988).</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>Council has also =
adopted policies=20
  related to staffing expenditures:</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>=B7 On February 4, =
1992, Council=20
  instructed that any recommendations for increased staff or enhanced =
programs=20
  be accompanied by recommendations for related revenue increases or =
offsetting=20
  expenditure reductions.</FONT></I></B></P>
  <P><B><I><FONT face=3D"Times New Roman" size=3D3>=B7 In November 1997, =
Council=20
  instructed that any costs associated with the Blueways work program be =
funded=20
  within the normal budget from tax revenues.</FONT></I></B></P>
  <P><FONT face=3D"Times New Roman" size=3D3>SUMMARY AND =
PURPOSE</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>In October 1997, City =
Council approved=20
  a number of recommendations related to the Blueways Program including =
the=20
  following short-term work items:</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>=B7 confirming =
jurisdiction/enforcement=20
  of regulations;</FONT> <BR><FONT face=3D"Times New Roman" size=3D3>=B7 =
revisions to=20
  the Health By-law to distinguish between live-aboard and short-term =
visitor=20
  moorage;</FONT> <BR><FONT face=3D"Times New Roman" size=3D3>=B7 design =
guidelines=20
  for public docks;</FONT> <BR><FONT face=3D"Times New Roman" =
size=3D3>=B7 endorsement=20
  of the Fraser River Estuary Management Plan; and</FONT> <BR><FONT=20
  face=3D"Times New Roman" size=3D3>=B7 advising on plans.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>Council also requested a =
report back on=20
  these items, as well as options for continuation of the Blueways=20
  Program.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>This work has now been =
completed,=20
  including a proposal for continuing staffing for one year to complete=20
  additional high priority work items. Funding would be from general =
revenues.=20
  Management of Blueways would be moved to Engineering Services. It is =
also=20
  recommended that the Water Opportunities Advisory Group (WOAG) =
continue to=20
  advise City Council and staff on water-related issues. Regardless of =
Council=92s=20
  decision on staffing, a number of policies and guidelines to direct =
future=20
  initiatives related to Vancouver=92s waterfront and waterways are =
recommended=20
  for approval.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>BACKGROUND</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>The Blueways initiative =
started in 1995=20
  when the WOAG was formed. The WOAG is made up of volunteers from the =
public=20
  and private sectors (see Appendix D for list of members). They were =
charged=20
  with the task of developing a set of recommendations that could form =
the basis=20
  of City policy for current and future planning of the waterfront. In =
June=20
  1996, Council approved a public consultation process to assist the =
WOAG which=20
  resulted in the publication of the Draft Blueways Document that was =
received=20
  by Council in October 1997. At that time, Council approved staff =
funding for a=20
  six-month period to work on a number of items requiring immediate =
action and=20
  to report back on options for implementing a Blueways =
Program.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>DISCUSSION</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3><B>1. Blueways =
Policies:</B> A number=20
  of policies and guidelines to direct future decisions and development=20
  affecting the city=92s water bodies and waterways are proposed in =
Appendix A.=20
  These policies were derived from the Draft Blueways Document which was =

  prepared with extensive public consultation. Items from the draft =
document=20
  that have been completed are not included. Staff and the WOAG have =
reviewed=20
  the remaining items and deleted any that were deemed lower priority. =
Adoption=20
  of the policies and guidelines will help ensure that future =
developments=20
  complement, enhance and preserve Vancouver=92s waterfront=20
  environments.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>The policies and guidelines =

  will:</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>=B7 encourage and support a =
diversity of=20
  waterfront uses, activities and structures that recognize a variety of =

  users;</FONT> <BR><FONT face=3D"Times New Roman" size=3D3>=B7 assess, =
protect and=20
  enhance waterfront habitat;</FONT> <BR><FONT face=3D"Times New Roman" =
size=3D3>=B7=20
  protect water-based industry; and</FONT> <BR><FONT face=3D"Times New =
Roman"=20
  size=3D3>=B7 increase public access to and along the =
waterfront.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3><B>2. Update on Work =
Items:</B> The=20
  WOAG and City staff have completed work on the priority initiatives as =

  directed by Council. These include:</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>(a) Jurisdiction and =
Enforcement:=20
  Determining jurisdictional responsibility in the City=92s waterways =
has been=20
  difficult due to the overlapping of authority and involvement of =
several=20
  regulatory agencies at all three levels of government. City staff have =
been=20
  working with their provincial and federal counterparts and private =
owners to=20
  clarify jurisdictional authority in False Creek. Through these =
discussions it=20
  was determined that the vast majority of boats are located on =
privately-owned=20
  water lots. It was also verified that water lot owners have the right =
to=20
  remove these boats, similar to a car being parked on a private land =
lot. City=20
  staff have met with other water lot owners and agreed to proceed with =
the=20
  removal of unauthorized vessels. The water lot owners in False Creek =
will be=20
  contracting a bailiff company and/or towing operators to carry out=20
  enforcement.</FONT></P>
  <UL>
    <UL>
      <P><FONT face=3D"Times New Roman" size=3D3>Recognizing that part =
of this=20
      problem is a result of the lack of temporary moorage for visiting =
boaters,=20
      Blueways staff have received approval for a development =
application to=20
      install visitor moorage buoys in False Creek at the foot of =
Charleson=20
      Park. The buoys will provide moorage for short-term visitors =
(i.e., 72=20
      hours) only. Funding for capital and operating costs of the =
moorage buoys=20
      is described in detail under the Financial Implications section of =
this=20
      report.</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>In response to concerns =
raised by=20
      boaters that the buoys would only address part of the moorage =
problem,=20
      staff have been working with Concord Pacific Group Inc. to develop =

      =93designated anchorage=94 areas on the north side of False Creek =
which would=20
      allow for some longer term anchorage. Concord Pacific is proposing =
to=20
      provide and operate anchorage areas on their water lots in False =
Creek.=20
      Staff are currently in discussion with representatives from =
Concord=20
      Pacific to coordinate activities. Enforcement against unauthorized =
boats=20
      in False Creek will commence once the buoys and the anchorage =
areas are=20
      operational which is expected to be early next =
year.</FONT></P></UL></UL>
  <P><FONT face=3D"Times New Roman" size=3D3>(b) Changes to Health =
By-law: The=20
  Director of Environmental Health has worked with Blueways staff in =
preparing a=20
  companion report and amendments to the Health By-law to distinguish =
between=20
  live-aboard moorage and short-term visitor moorage for Council=92s=20
  consideration. Adoption of the recommendations in the report will =
complete=20
  this work and permit short term moorage.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>(c) Dock Design =
Guidelines/Water=20
  Transportation System: Dock design guidelines have been completed and =
are=20
  attached as Appendix E. The design guidelines will ensure that public =
docks=20
  will have a consistent design and permit multiple users. The dock and =
ramp=20
  supplier will be responsible for all details of the dock and ramp and =
must=20
  provide drawings sealed by a Professional Engineer for review by the =
City=20
  Engineer</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>prior to approval. The dock =
design must=20
  meet all applicable design codes. The City Engineer will review the =
design=20
  using the General Guidelines for Docks in Vancouver (see Appendix E).=20
  Development and building permits must also be obtained when and as =
required.=20
  Engineering staff are completing further work to determine methods and =

  associated costs for providing barrier free access to =
docks.</FONT></P>
  <UL>
    <UL>
      <P><FONT face=3D"Times New Roman" size=3D3>Staff and the WOAG have =
also=20
      prepared a False Creek Water Transportation Management discussion =
paper=20
      which will provide guidance for the ownership, administration, and =

      location of ferry docks. It also proposes integration of ferries =
with the=20
      transportation system as is being contemplated in the Downtown=20
      Transportation Plan.</FONT></P></UL></UL>
  <P><FONT face=3D"Times New Roman" size=3D3>(d) Endorsement of Fraser =
River Estuary=20
  Management Plan: This work has also been completed and is subject of a =

  companion report. Adoption of the recommendations in that report will =
complete=20
  this work.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>(e) Advising on Plans and =
Development=20
  Proposals: Staff and the WOAG have reviewed and provided input on =
several=20
  planning initiatives including South East False Creek, the Plaza of =
Nations=20
  rezoning, and the proposed expansion of the False Creek Yacht Club. =
Continuing=20
  to provide advice on development proposals is part of the proposed =
work=20
  program that is described below. Study areas have also been =
established, so=20
  that Blueways staff will be advised of any proposed development =
adjacent to=20
  the waterfront.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3><B>3. Actions to Continue =
Blueways=20
  Program:</B> A strong foundation for the Blueways program has been =
established=20
  with a good level of public support. While a number of significant =
work items=20
  have been completed, there is much more to be done. In order for =
Blueways to=20
  build upon this support and successes in a meaningful way, additional=20
  resources are recommended.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>(a) Priority Work Items: =
With reference=20
  to the Blueways document, staff and the WOAG have identified the =
following=20
  high priority work items:</FONT></P>
  <UL>
    <UL>
      <P><FONT face=3D"Times New Roman" size=3D3>(i) Develop a Visitors =
Greeting=20
      Centre and a Central Registration System</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>A visitors greeting =
centre would=20
      provide boaters with information regarding temporary moorage, =
Coast Guard,=20
      customs, marine facilities, provisioning, safety and pollution =
issues and=20
      tourist activities. The False Creek Yacht Club is proposing to =
include=20
      such a visitor centre as part of an expansion proposed in a =
rezoning=20
      application that is currently under review. The visitors centre =
could also=20
      be home to a central registration system to coordinate and reserve =
vacant=20
      moorage slips. Blueways staff would be responsible for collecting=20
      information and in assisting with the development of the =
registration=20
      system. Additionalwork on the =93start-up=94 of the temporary =
moorage buoys in=20
      Charleson Bay is required, including preparation of a brochure =
outlining=20
      the new anchorage and moorage areas in False Creek, as well as for =
the=20
      renewal of the development permit which is valid until October 31, =
1999.=20
      </FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>(ii) Management of =
False=20
      Creek</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>The Vancouver Port =
Corporation and=20
      the Ministry of Environment, Land and Parks have approached the =
City=20
      regarding the potential to hand over control of False Creek to the =
City.=20
      The General Manager of Engineering Services will be reporting to =
Council=20
      on this matter in the very near future. The WOAG and Blueways =
staff will=20
      act in an advisory capacity to Council, the Corporate Management =
Team and=20
      City staff as required. An important component of this would be =
the=20
      development of a water use plan. Blueways staff would assist in =
the=20
      preparation of a water use plan for False Creek which would ensure =

      compatibility between water and land uses and the transportation =
system,=20
      and aid in the development of the Downtown Transportation Plan. A =
water=20
      use plan would also assist in reducing conflicts among and ensure=20
      accessibility for all users. Plans for the city=92s other =
waterways would be=20
      completed as time permitted.</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>(iii) Water Quality and =
Shoreline=20
      Environment</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>Staff are proposing to =
work with=20
      one or more community groups on habitat enhancement projects. For =
example,=20
      the Friends of False Creek have proposed a small scale habitat =
restoration=20
      and water quality monitoring program for False Creek that will be =
funded=20
      by external sources. Staff would be available to facilitate =
initiatives=20
      similar to this, but no funding would be allocated to groups =
without City=20
      Council approval. Some shoreline enhancement work is already =
underway as=20
      the Cypress Environmental Youth team has been working on =
naturalizing=20
      Maple Beach and restoring the sea wall at Stamp=92s Landing. =
Further work=20
      also needs to be completed in conjunction with the Director of=20
      Environmental Health in pursuit of creating a =93no dumping=94 =
designation for=20
      False Creek and English Bay through the Federal Pleasure Craft =
Sewage=20
      Disposal Regulations.</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>(iv) Jurisdiction and =
Resolution of=20
      Conflicts Between Water Users</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>The city=92s water =
bodies and=20
      waterways are enjoyed by many users and as the number of users =
increases=20
      so does the potential for conflicts. Further work is required to =
refine=20
      jurisdictional responsibility to ensure safety in the City=92s =
waterways.=20
      This could include the publication of a brochure describing =
existing rules=20
      and regulations for water users and developing additional =
regulations as=20
      required.</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>(v) Advising on Plans =
and=20
      Development Proposals and Coordination with other =
Initiatives</FONT></P>
      <P><FONT face=3D"Times New Roman" size=3D3>This task is a =
continuation of a=20
      current work program and would ensure Blueways input into planning =

      initiatives in South East False Creek, area rezonings at Concord =
Pacific=20
      lands and the Trade and Convention Centre developments. Blueways =
staff=20
      would also represent City interests on an Environment Canada =
Committee=20
      that has been formed to address impacts from boating in the =
Georgia Basin,=20
      including Burrard Inlet and the Fraser River.</FONT></P></UL></UL>
  <P><FONT face=3D"Times New Roman" size=3D3>(b) Management and =
Resources: To date,=20
  the Blueways Program has been managed and staffed by the Planning =
Department,=20
  while other City departments such as Engineering and Parks have =
contributed=20
  staff resources to attend meetings of the WOAG. For the future, it is =
proposed=20
  that management of Blueways be moved to the Greenways section in the=20
  Engineering Department. Greenways staff have been part of the WOAG and =
are=20
  familiar with the objectives of the Blueways Program. In addition, =
this=20
  alignment will create opportunities for collaboration on projects. =
Planning=20
  staff will continue to be actively involved through the =
WOAG.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>The Water Opportunities =
Advisory Group=20
  and senior managers discussed a number of staffing options for the=20
  continuation of Blueways. Current work programs in Planning and =
Engineering=20
  are fully committed and any further work on Blueways with existing =
resources=20
  would be at the expense of work in other areas such as Transportation =
or=20
  Greenways. It was concluded that additional staffing in the form of a=20
  full-time Planning Analyst for a period of one year would be required =
to deal=20
  with a number of important work items outlined above. If City Council =
does not=20
  approve RECOMMENDATION B to provide staffing, additional work on =
Blueways=20
  would be delayed indefinitely.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>FINANCIAL =
IMPLICATIONS</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>It is recommended that the =
funding=20
  resources for staffing the Blueways Program in the amount of $56,070 =
(see=20
  Appendix B) come from the 1999 Operating Budget, as Council has =
directed that=20
  any costs associated with the Blueways work program be funded within =
the=20
  normal budget from tax revenues. Approval of RECOMMENDATION B will =
provide=20
  funding for staffing for a period of one year.</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>In addition, funding of $ =
60,000 to=20
  install the 15 mooring buoys in False Creek is also being requested =
(see=20
  Appendix C) with the source of funds to be the Property Endowment =
Fund, and=20
  would be repaid from mooring buoy revenue. It is estimated that =

revenue from=20
  the mooring buoys to be $55,000. This is based on $15/night moorage =
fee and=20
  varying levels of occupancy depending on the season. (See Appendix C =

  detailed analysis.) It is estimated that once the capital costs have =

  repaid, the moorage buoys will generate $40,000 annually after =
operating costs=20

IMPLICATIONS</FONT></P>

  guidelines listed in Appendix A will provide direction to improving =
water=20
  quality and shoreline environment around the city. In addition, =
approval of=20
  the work program outlined in this report will allow for dedicated =
staff time=20
  to pursue water quality and habitat enhancement projects with =
community=20
  groups. Designation of English Bay and False Creek under the Federal =
Pleasure=20
  Craft Sewage Disposal Regulations will also result in improvements to =
water=20
  quality in these areas.</FONT></P>

ADVISORY GROUP=20
  (WOAG)</FONT></P>
  <P><FONT face=3D"Times New Roman" size=3D3>The WOAG was established in =
1995 and=20
  has been critical to the success of the Blueways Program to date. This =

  has been meeting on a monthly basis and has provided valuable input =

  guidance. A number of community interest groups have expressed a =
desire to=20
  join the WOAG. However, staff feel that the various interest groups =
are=20
  represented through the three public positions on the WOAG and that=20
  opportunities for membership will come open as positions become =
vacant. The=20
  addition of more members could result in decreased operational =
efficiency.=20
  Therefore, it is recommended that Council endorse the existing =
structure and=20
  composition of the Water Opportunities Advisory Group (as in Appendix =
D) and=20
  that they continue to advise Council on water-related =
