Encroachments involving adjacent properties

This is a private matter between the property owners. Please contact a BC land surveyor if you would like to establish the location of a common property line or determine the extent of any potentially encroaching elements.

Land titles and registered encumbrances

The titles to all privately owned properties located within the Province of BC are registered through the Land Title Office operated by the Land Title and Survey Authority (LTSA) under the direction of the Registrar of Land Titles. Charges are registered on the titles to these properties for items such as easements, statutory right of ways, and covenants, along with financial encumbrances, such as mortgages or liens.

Information about privately owned properties, including charges registered to a certificate of title and related survey plans, are available through the Land Title Office and the LTSA.

We do not manage or maintain any title information or charge documents related to a specific parcel of land and do not conduct surveys or locate property lines related to privately owned parcels.
Easement and statutory right of ways

Easements and statutory rights of way are usually registered on the certificate of title of the property.

Easements

An easement is a registered interest in land that provides certain rights of one property owner to use the land of another for a specific purpose such as rights of access or the right to install and maintain drainage works and pipes. These agreements are typically between adjacent property owners.

Statutory right to ways

A statutory right of way (SRW) is a specific form of easement between a property owner and an authorized legal entity such as local governments (for example, City of Vancouver) or utility providers (for example, BC Hydro). These agreements are typically provided to validate rights of access and public utilities that cross private lands.

Survey of property

We do not provide surveying services for private properties. Please contact a local BC Land Surveyor to have your property surveyed. This includes re-establishment of property lines, location of fences, and surveys required for mortgage or development purposes.
